Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Athle mobile application, website and related services (collectively, “Athle” or the “Service”).

By creating an Athle account or using the Service, you agree to these Terms.

If you do not agree to these Terms, you must not use Athle.

1. About Athle

Athle is a fitness platform designed to make physical activity more engaging through activity tracking, challenges, progression, rankings, seasons and rewards.

Depending on the features available to you, Athle may allow you to:

• track fitness and activity data;
• connect compatible health and fitness services;
• participate in daily, weekly and other challenges;
• compete against other Athle users;
• participate in rankings and leaderboards;
• progress through seasons and levels;
• earn Season Points (“SP”);
• earn Shop Points (“SHP”);
• unlock achievements and rewards;
• participate in Matchfinder or similar competitive features; and
• access other fitness-related functionality.

Features may be added, changed or removed as Athle develops.

2. Eligibility

You must be at least 16 years old to create and use an Athle account.

By creating an account, you confirm that you meet this minimum age requirement.

If applicable law in your country requires additional parental or guardian consent for certain data processing or services, you are responsible for meeting those requirements.

3. Your Account

Certain Athle features require an account.

Accounts may be created using supported methods such as:

• email;
• Sign in with Apple; or
• Sign in with Google.

You are responsible for maintaining the security of your account and for activity performed through your account.

You must provide accurate information and must not impersonate another person.

Athle may suspend or restrict accounts where there is reasonable evidence of fraud, manipulation, abuse or violation of these Terms.

4. Fitness and Health Data

Athle may use fitness and health-related information to provide its core functionality.

Depending on the permissions you grant and the features you use, this may include information such as:

• steps;
• distance;
• calories burned;
• workouts and workout information;
• heart rate;
• sleep information;
• location or GPS information; and
• other fitness or activity information supported by Athle in the future.

On Apple devices, certain information may be accessed through Apple Health and HealthKit.

Athle will request the relevant device or HealthKit permissions before accessing protected information.

You control which HealthKit data categories Athle is permitted to access through Apple's permission system.

You may change or revoke these permissions through your device or Apple Health settings.

5. Purpose of Fitness Data

Fitness and activity data may be used to provide functionality including:

• measuring activity;
• displaying personal statistics and progress;
• calculating challenge progress;
• verifying completion of challenges;
• calculating SP and SHP where applicable;
• determining season progression;
• providing rankings and leaderboards;
• operating competitive features;
• detecting suspicious or manipulated activity; and
• improving fitness-related Athle functionality.

Athle does not sell HealthKit data.

HealthKit data is not used for third-party advertising.

6. Apple Health and HealthKit

Where you choose to connect Apple Health, Athle may request permission to read specific categories of data required for supported features.

Permission is controlled by Apple and may be granted or denied separately for individual data categories.

You can revoke Athle's access at any time through Apple Health or your device privacy settings.

Some Athle functionality may become unavailable or less accurate if access to required fitness information is denied or revoked.

Athle will only request HealthKit information reasonably connected to fitness functionality provided by Athle.

7. Location Data

Certain Athle functionality may use location or GPS information, particularly where location is required to verify or measure an activity.

Athle will request the applicable device permission before accessing location information where required.

You can disable location access through your device settings.

Disabling location access may prevent certain activity-tracking or verification features from functioning correctly.

8. Public Profile Information

Certain information associated with your Athle identity may be visible to other users.

This may include:

• username;
• level;
• achievements;
• rank;
• leaderboard position;
• season progress or status; and
• other competitive or progression information.

Your underlying private health information, such as heart-rate or sleep data, is not made publicly visible merely because you participate in Athle.

Certain activity information may be shown to another user where necessary for a feature in which you intentionally participate, such as Matchfinder or a direct competition.

9. Challenges and Matchfinder

Athle may allow users to participate in challenges or compete against other users.

Challenge results may be determined using fitness or activity information available to Athle.

By voluntarily entering a competition or Matchfinder activity, you understand that information necessary to operate and display that competition may be visible to the other participant or participants.

Athle may introduce additional competition formats in the future.

10. Season Points (SP)

Athle may award Season Points (“SP”) for eligible activity, challenges or other actions.

SP are used for progression, ranking and season-related functionality.

SP:

• have no monetary value;
• cannot be exchanged for cash;
• cannot be transferred between users unless Athle explicitly introduces such functionality;
• cannot be purchased with SHP; and
• may expire or reset in connection with the relevant season.

Athle seasons are currently designed to last approximately 90 days, although Athle may adjust season length where reasonably necessary.

Rules and point calculations may vary between seasons.

11. Shop Points (SHP)

Athle may award Shop Points (“SHP”) through eligible activities, challenges, achievements or other features.

SHP may be used for eligible rewards made available within the Athle ecosystem.

SHP:

• are not legal currency;
• have no cash value;
• cannot be exchanged for cash;
• cannot be withdrawn;
• cannot be sold;
• cannot be transferred unless Athle explicitly permits it; and
• cannot currently be purchased with real money.

Athle may determine which activities award SHP and how many SHP are required for individual rewards.

12. Rewards

Athle may offer rewards including:

• digital cosmetics;
• badges;
• profile customizations;
• titles;
• Athle products;
• products or benefits from partner brands;
• discounts;
• promotional rewards; and
• other rewards introduced in the future.

Availability may vary by country, user, season and stock.

Physical rewards may be subject to shipping restrictions, availability, taxes, customs charges or other conditions communicated before redemption.

A reward displayed within Athle is not guaranteed to remain permanently available.

Athle may replace, modify or discontinue rewards where reasonably necessary.

13. Reward Errors and Abuse

Athle aims to calculate activity, SP, SHP, rankings and rewards accurately.

However, technical errors, synchronization problems, duplicated fitness records or incorrect information from connected services may occur.

Athle may correct balances, rankings, challenge results or rewards where they were clearly generated as a result of:

• technical errors;
• duplicated activity;
• manipulated activity;
• fraudulent activity;
• unauthorized software;
• exploitation of bugs; or
• other abuse of the Service.

Athle will not arbitrarily remove legitimately earned rewards.

14. Fair Use and Anti-Cheating

You must not manipulate fitness information or Athle systems to obtain SP, SHP, rankings, achievements or rewards unfairly.

Prohibited behavior includes intentionally:

• submitting fabricated activity;
• manipulating step counts or workout records;
• exploiting bugs;
• automating activity submissions;
• using unauthorized tools to manipulate results;
• creating multiple accounts to exploit rewards;
• interfering with Athle systems; or
• attempting to obtain rewards through fraudulent means.

Athle may invalidate affected activity or rewards and may restrict or suspend accounts involved in abuse.

15. Digital Cosmetics

Athle may allow users to unlock cosmetic items using SHP, achievements, seasonal progression, rankings or other methods.

Cosmetics may include profile frames, username styles, titles, badges, Matchfinder card designs and similar visual items.

Cosmetics:

• have no monetary value;
• cannot be exchanged for cash;
• provide no competitive fitness advantage; and
• may be subject to availability or seasonal restrictions.

16. Physical Products

Athle may in the future offer physical products through Athle or a separate Athle online store.

Additional sales terms may apply to purchases of physical goods.

Where products are supplied or fulfilled by third-party partners, relevant shipping and fulfillment information will be provided during the purchasing or redemption process.

17. No Medical Advice

Athle is a fitness and motivational platform.

Athle does not provide medical advice, diagnosis or treatment.

Information, statistics, challenges, recommendations, rankings and other content available through Athle are provided for fitness and informational purposes only.

Do not rely on Athle as a substitute for professional medical advice.

You are responsible for determining whether an activity is appropriate for your personal circumstances.

If you have concerns regarding your health or ability to exercise, consult an appropriate healthcare professional.

18. Exercise Risks

Physical exercise involves inherent risks.

You are responsible for exercising within your own abilities and for using appropriate judgment when participating in workouts, challenges or competitions.

Do not continue an activity if you experience symptoms that require medical attention.

Athle does not guarantee that any particular challenge, workout or activity is appropriate for every user.

19. Availability of the Service

Athle is under active development.

We aim to provide a reliable service but cannot guarantee uninterrupted or error-free availability.

Features may temporarily become unavailable because of:

• maintenance;
• technical failures;
• third-party service failures;
• updates;
• security measures; or
• circumstances outside our reasonable control.

Athle may modify or discontinue individual features as the Service develops.

20. Third-Party Services

Athle relies on third-party technology and services.

These may include authentication providers, cloud infrastructure, analytics, crash reporting, health platforms and other technical providers.

Use of certain third-party functionality may also be subject to the relevant provider's terms and privacy policies.

21. Intellectual Property

Athle, including its branding, software, designs, graphics, logos, interfaces and original content, is protected by applicable intellectual property laws.

Unless explicitly permitted, you may not:

• copy;
• reproduce;
• distribute;
• sell;
• reverse engineer;
• commercially exploit; or
• create unauthorized derivative works from Athle or its content.

Nothing in these Terms transfers ownership of Athle intellectual property to you.

22. Acceptable Use

You may not use Athle:

• unlawfully;
• fraudulently;
• to interfere with the Service;
• to gain unauthorized access to systems or accounts;
• to distribute malicious software;
• to manipulate competitions or rewards;
• to impersonate another person; or
• in any way that materially harms Athle or other users.

23. Account Suspension and Termination

Athle may suspend or terminate access where reasonably necessary because of:

• serious or repeated violations of these Terms;
• fraud;
• cheating;
• manipulation of rewards or activity;
• security threats;
• unlawful use; or
• other serious abuse.

Where appropriate and reasonably possible, Athle may provide notice before termination.

You may stop using Athle at any time and may request deletion of your account through the methods made available by Athle.

24. Account Deletion

Users may request deletion of their Athle account.

Account deletion will be handled in accordance with the Athle Privacy Policy and applicable legal requirements.

Certain information may need to be retained where required by law, necessary to resolve disputes, prevent fraud or protect legitimate legal interests.

25. Disclaimers

To the extent permitted by applicable law, Athle is provided on an “as available” basis.

Athle does not guarantee:

• uninterrupted availability;
• perfect accuracy of third-party fitness information;
• achievement of fitness results;
• continued availability of a specific reward;
• a particular leaderboard position; or
• that every device or external service will always remain compatible.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

26. Limitation of Liability

To the extent permitted by applicable law, Athle is not liable for indirect or consequential losses arising from use of the Service.

Nothing in these Terms limits liability where such limitation is prohibited by law, including liability that cannot legally be excluded under applicable consumer protection law.

27. Changes to Athle

Athle will continue to evolve.

We may introduce, modify or discontinue features, reward structures, challenge formats, seasons, SP/SHP mechanics or other functionality.

Where a change materially affects your legal rights, we will provide appropriate notice where required.

28. Changes to These Terms

We may update these Terms where necessary because of:

• changes to Athle;
• new functionality;
• changes in law;
• security requirements; or
• operational requirements.

The current version will be made available through Athle or the Athle website.

For material changes, we may request that you review and accept the updated Terms before continuing to use relevant parts of the Service.

29. Governing Law

These Terms are governed by the laws of Switzerland, subject to any mandatory consumer protection rights that apply to you in your country of residence.

Nothing in these Terms removes mandatory rights available to consumers under applicable law.
